Unless another address is communicated in writing before the return, the registered office above is also the address for complaints and authorised returns.

These terms apply to photographic prints, limited editions and other artworks presented on mirelabichigeanu.ro and purchased remotely from HIDRO METHOD S.R.L.

The website currently presents available works but does not provide an automated online checkout. A visitor may initiate an enquiry through the contact form or by email. Sending an enquiry does not create an obligation to purchase and does not automatically reserve a work.

Any individual written offer or order confirmation forms part of the sales agreement. If a specific written agreement conflicts with these general terms, the individually agreed provision will prevail.

The description provided for each work may include the title, photographic series, year, dimensions, printing process, paper, edition size, signature and availability.

Where applicable, limited-edition prints are signed, numbered and supplied with a certificate of authenticity. Edition numbers are allocated according to availability and any written agreement made with the customer.

Images displayed on a screen are provided for presentation purposes. Colours, contrast, texture, proportions and fine details may differ slightly from the physical work because of screen calibration, image compression, materials and printing processes.

Hand-finished, signed or individually produced works may contain minor variations that are inherent to the artistic process and do not constitute defects.

The current ordering process is:

• the customer sends an enquiry through the website form or by email;
• the seller confirms availability, specifications, price, estimated production time and delivery cost;
• the customer confirms the proposed specifications and delivery details;
• the seller issues a written order confirmation and the relevant payment document;
• the customer completes payment using the instructions received directly from the seller;
• production or preparation for dispatch begins as agreed.

A sales contract is concluded when the seller expressly accepts the order in writing and the customer accepts the confirmed price, specifications and these Terms of Sale.

The seller may decline an enquiry where a work is no longer available, the requested production is technically impossible, delivery cannot be arranged or there is an evident error in the information provided.

The final price, applicable currency, VAT treatment, production costs, framing where requested, delivery costs and any other charges will be stated clearly in the written offer or order confirmation.

Unless expressly stated otherwise, prices offered to consumers include applicable VAT. Delivery charges and import charges are presented separately.

Payment is currently accepted by bank transfer to the business account indicated in the order confirmation or invoice issued by HIDRO METHOD S.R.L.

Customers should make payments only using banking instructions received through verified communications from contact@mirelabichigeanu.ro . Any unexpected request to pay a different beneficiary or bank account should be verified by telephone before payment.

Bank charges applied by the customer’s bank or intermediary banks are borne by the customer unless otherwise agreed. The seller must receive the full amount stated in the order confirmation.

An order may be cancelled if payment is not received within the period stated in the written confirmation.

Delivery may be arranged in Romania, within the European Union and internationally, subject to courier availability, destination restrictions and the characteristics of the work.

Before payment, the customer will be informed of:

• the estimated production or preparation period;
• the available delivery method;
• the estimated delivery period;
• the delivery price;
• any known destination restrictions.

Delivery dates are estimates unless a specific date has been expressly guaranteed in writing. Delays caused by customs procedures, carriers, weather, transport disruptions or other circumstances outside the seller’s reasonable control will be communicated as soon as reasonably possible.

Customers are responsible for providing a complete and accurate delivery address, telephone number and any information required by the carrier.

For deliveries outside the European Union, customs duties, import VAT, brokerage fees or other destination charges may apply. Unless expressly included in the order confirmation, these charges are payable by the recipient.

Please inspect the package and the work promptly after delivery. If the external packaging is visibly damaged, note the damage with the carrier where possible and retain all packaging materials.

Transport damage should be reported as soon as possible to contact@mirelabichigeanu.ro , preferably within 48 hours of delivery.

Please include:

• the order or invoice number;
• photographs of the external packaging;
• photographs of the internal protection;
• clear photographs of the damaged work;
• a short description of the issue.

The 48-hour notification request helps with claims against the carrier but does not remove or reduce any mandatory statutory consumer rights.

A consumer purchasing a standard, non-personalised work through a distance contract generally has the right to withdraw from the contract without giving a reason within 14 calendar days.

The withdrawal period begins on the day after the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods.

To exercise this right, the consumer must send an unequivocal withdrawal statement before the 14-day period expires. The model form provided at the end of this page may be used, but its use is not mandatory.

Before sending the work, the customer should request return instructions so the package can be correctly identified and delivered safely.

The statutory right of withdrawal may not apply to goods made to the consumer’s specifications or clearly personalised.

This may include, where individually requested:

• non-standard print dimensions;
• personalised inscriptions or dedications;
• custom framing or mounting specifications;
• special materials or finishes selected by the customer;
• a work produced according to unique customer requirements.

The customer will be informed clearly before placing the order whenever the requested specifications make the order exempt from the statutory right of withdrawal.

A print is not treated as non-returnable merely because it belongs to a limited edition or is prepared after an order. The exception applies only where the legal requirements for customised or clearly personalised goods are met.

This exception does not affect the customer’s rights where a work is defective, damaged or does not conform to the agreed description.

After notifying the seller of withdrawal, the consumer must return the work without undue delay and no later than 14 calendar days after sending the withdrawal notice.

Unless the seller agrees otherwise or the work is defective, the direct cost and responsibility for returning the work are borne by the customer.

The work must be packed securely, preferably using its original protective packaging. Because photographic works can be fragile, a tracked and appropriately insured delivery service is recommended.

The customer is responsible only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and condition of the work.

Eligible payments will be refunded without undue delay and no later than 14 days after the seller is informed of the withdrawal. The seller may withhold the refund until the returned work is received or the customer provides evidence that it has been sent back, whichever occurs first.

The refund includes the original standard delivery cost where required by law. Additional costs resulting from a more expensive delivery method selected by the customer are not refundable.

Refunds are normally made using the original payment method unless another method is expressly agreed.

Consumers benefit from the mandatory legal guarantee of conformity provided by applicable Romanian and European Union consumer law.

If a work is damaged, defective or materially different from the agreed description, please contact the seller and provide the order details and relevant photographs.

Depending on the circumstances and legal requirements, the available remedy may include repair, replacement, an appropriate price reduction or termination of the contract and reimbursement.

Nothing in these Terms of Sale restricts mandatory rights available to consumers under applicable law.

Ownership of the physical print or artwork passes to the customer after full payment and delivery, subject to applicable law.

Purchasing a physical work does not transfer copyright, reproduction rights, publishing rights, commercial-use rights or any other intellectual property rights.

Copyright remains with Mirela Bichigeanu unless a separate written licensing agreement expressly provides otherwise.

The purchaser may display the physical work for private purposes and may resell that physical object, subject to applicable law. The work may not be reproduced, published, modified, licensed, tokenised or used commercially without prior written permission.

These Terms of Sale and contracts concluded under them are governed by Romanian law and applicable European Union law.

Consumers retain the benefit of any mandatory protections provided by the law of their country of habitual residence where such rules apply and cannot lawfully be excluded.

Romanian consumers may also contact the National Authority for Consumer Protection through www.anpc.ro .

Any dispute that cannot be resolved amicably will be submitted to the competent courts determined under applicable law.
